INTRODUCTION:

  • Copyright means an exclusive legal right, given to an originator or an assignee to print, publish, perform, film or record literary, artistic or musical material and to authorise others to do the same.This is relevant to scholarly (booklets, scripts, sometimes even software) and audio-visual (music pieces, photography, movies) production. Copyright is generally possessed by the author of the work, but sometimes could also be held by the employer of its inventor or the individual who had delegated the task (unless the company and the employee have an agreement). Copyrights can also be transferred.

ADVANTAGES OF COPY RIGHT REGISTRATION

  • 1. A Copyright Registration grants its proprietor exclusive rights to duplicate or imitate the work or give authorisation to another entity for the same. 
    2. Registration is a legal evidence of ownership,if somebody takes your work, registration will avoid a costly dispute over the actual ownership.
    3. Your work will be published in the copyright office’s catalog  and will be searchable to public. Anybody thinking of using this work will be able to seach this catalog and see that your work is protected.
    4. With a registration, the copyright holder is entitled to statutory damages and attorneys’ fees.  Rather than having to prove actual damages, a copyright holder with a timely registration may be eligible for statutory damages of up to $150,000 per infringement, plus attorneys’ fees.  However, to claim these damages, the registration must be made within three months of the work’s publication or before the infringement occurs.  Therefore, time is of the essence.
    5. Copyright is a one-time registration process. The registration doesn’t require renewal unless if there is a change in the owner particulars, thereby reducing the maintenance cost.
    6. If the work is registered, the owner can produce or distribute the copies or even broadcast or give permission to use his work through which he can earn from his work.
    7. The registered copyright is mandatory for carrying on trade.

Document Required:-

 

 According to the work every one has to submit the different documents which are:-
1. Artistic:- 

2 Copies of work (whatever he done the creativity)

   DD /IPO of the amount according to the work and quantity per work
    If applicant is different from Artistic,  NOC is required from the artistic.
    If work published and publisher is different person, NOC from publisher.
   NOC from person whose photograph appears on the work.
   A specific Power of Attorney in original duly signed by the applicant and must be accepted by the attorney, If the application for the copyright is being filed by any ways from the attorney.
2. Cinematograph Film:- 
    2 Copies of work
     DD/IPO of Rupees as per work
    NOC from various copyright holders or copy of agreement.
    If work published and publisher is different person, NOC from publisher .
    If the application is being filed through attorney, a specific Power of Attorney in original duly signed by the applicant and accepted by the attorney.
3. Music: – 
    2 Copies of work (Graphical Notes)
   DD/IPO of Rupees as per work
    NOC from publisher if work published and publisher is a different person.
    NOC from author if applicant is other than author.
   If the application is being filed through attorney, a specific Power of Attorney in original duly signed by the applicant and accepted by the attorney.
4. Software: – 
     2 Copies of work
     DD/IPO of Rupees as per work
     NOC from author if author is different from applicant.
     NOC from publisher if work is published and publisher is a different person.
     If the application is being filed through attorney, a specific Power of Attorney in original duly signed by the applicant and accepted by the attorney source code and object code of work for verification.
5. Sound Recording: -Document required for copyright registration are as follow
    2 Copies of work
    DD/IPO of Rupees as per work
    NOC from various copyright holders or copy of agreement.
    NOC from publisher if work published and publisher is different from applicant.
    If the application is being filed through attorney, a specific Power of attorney in original duly signed by the applicant and accepted by the attorney.

Procedure of Registration:-

  • 1. Application shall be filed with complete details and copies of work. 
    2. Thereafter, the application is examined and objections, if any, are raised, or any extra documents required are requested.
    3. A response against the objection has to be filed within 30 days.
    4. After the objections, if any, are removed to the satisfaction of the Copyright Registry.
    5. The certificate is issued by the copyright office.
